THE IRAN SANCTIONS ORDERS
Explanatory Notes for UK Exporters
WARNING:
These notes are intended for the guidance of exporters;
they do not claim to be an authoritative statement of the law. Exporters should obtain copies of the Orders from HMSO and if in doubt should seek legal advice.
THE ORDER S:
Economic sanctions against Iran have been intro- duced with effect from midnight on 29 May 1980 under two Orders:
(i) The Export of Goods (Control)(Iran Sanctions) Order 1980 made by
the Secretary of State for Trade on 29 May 1980 under Section 1 of the Import, Export and Customs Powers (Defence) Act 1939, which prohibits the export of embargoed goods to Iran;
(ii) The Iran (Trading Sanctions) Order 1980, an Order in Council made on 29 May 1980 under Section 1 of the Iran (Temporary Powers) Act 1980, which prohibits the making or performance of contracts for the sale, supply or transport of embargoed goods to Iran.
TERRITORIAL APPLICATION: The Iran (Trading Sanctions) Order 1980 extends to the United Kingdom, the Channel Islands, the Isle of Man and the UK's dependent territories (which are listed in Schedule 2 to the Order). The Export of Goods (Control)(Iran Sanctions) Order applies to the UK only but parallel action is being taken in the other territories.
EMBARGOED GOODS: The prohibitions in the Orders apply to all goods exported to Iran for the use of any person in Iran including the Government of Iran, any Iranian Government organisation and any body, whether corporate or unincorporate, with the following exceptions:
(i)
FOODSTUFFS. These are defined in Schedule 1 Part IA in each Order as all the commodities, foods and drinks falling within chapters 1 to 23 of the Common Customs Tariff and parts of two subheadings in chapters 33 and 35.
(ii) MEDICAL SUPPLIES. These are defined in Schedule 1 Part IB of both
Orders by reference to subheadings in the Common Customs Tariff. Part II of Schedule 1 lists other products which can be used for medical or surgical purposes and which will also be excepted where sold or supplied for use solely or mainly for such purposes.
(iii) Personal effects and professional equipment of passengers, whether
travelling by land, sea or air;
(iv) Ships and aircraft operating on scheduled services or re-exported
after temporary importation.
