2. This clause does not apply to any measure until the Secretary

of State makes an order by statutory instrument, subject to annulment in

pursuance of a resolution of either House of Parliament, specifying that

measure which has been or is proposed to be taken by or under the law of

an overseas country for regulating or controlling international trade and

which is damaging or threatens to damage the trading interests of the

United Kingdom. The Secretary of State may also by order require persons

carrying on business in the UK to inform him of any requirement or prohi-

bition imposed or threatened to be imposed pursuant to any such measure.

The purpose of this

provision is to ensure that the Secretary of State will be aware of the

precise circumstances under which such overseas measures are affecting UK

trading interests. It is not anticipated that it would be necessary to

make such a disclosure order except in unusual circumstances. A person

potentially affected by overseas measures would normally be willing to

co-operate with the Department. Lastly the Secretary of State may direct any

person in the United Kingdom who carries on business in the United King-

dom not to comply with any such requirement or prohibition imposed by the

overseas measuré as he considers appropriate for avoiding damage to the

trading interest of the United Kingdom.

3. The clause is intended to apply to the widest range of measures relat--

ing to international trade including air and sea transport and is simi-

larly intended to protect the widest range of the United Kingdom's trad-

ing interests.
