AT A MEETING WITH DOT AND CAA ON 18 NOVEMBER TO DISCUSS PROPOSALS WE CONCLUDED THAT THEY WERE UNACCEPTABLE ON 2 MAIN COUNTS:
(A) LACK OF PROVEN COMPETENCE

POTENTIAL CLASH OF INTERESTS
2. WE ARE NOT SATISFIED THAT THE PRESENT PROPOSALS ENSURE THAT YOU WOULD BE PROPERLY ADVISED ON TECHNICAL AND OTHER MATTERS INVOLVED IN THE CORRECT DISCHARGE OF YOUR RESPONSIBILITIES UNDER THE AIR NAVIGATION (OVERSEAS TERRITORIES) ORDER L977, FOR EXAMPLE ARTICLE 8, OR THAT THE FUNCTIONS CONCERNED COULD BE
PROPERLY DELEGATED IN THIS WAY.
3. COMPETENCE. IT IS NORMAL IN OTHER DEPENDENCIES (AND INDEED SOME INDEPENDENT COMMONWEALTH COUNTRIES) TO USE THE SERVICES OF THE CAA FOR ENSURING THAT SAFETY AND AIRWORTHINESS CRITERIA ARE APPLIED UP TO UK STANDARDS, AND LIKEWISE ANY LICENSING OF PERSONNEL. (CAA HAVE ALREADY OFFERED TO PROVIDE THIS SERVICE.)
IT IS NOT A LEGAL REQUIREMENT TO USE CAA STAFF FOR THIS PURPOSE:
BUT AS THE CAA ARE HMG'S ADVISERS ON AVIATION SAFETY, THEY WOULD HAVE TO TEST THE COMPETENCE OF ANY OTHER PERSONNEL SUCH
AS OUTSIDE EXAMINERS (WHATEVER STANDARDS THEY MIGHT CLAIM TO TEST UP TO) AND CONTINUE TO MONITOR THEIR PERFORMANCE. THE VERY
HIGH COSTS INCURRED WOULD BE CHARGED TO YOUR GOVERNMENT. PROBLEMS OF JURISDICTION AND THE EXERCISE OF EFFECTIVE CONTROL COULD ARISE IF THESE EXAMINERS AND THEIR EQUIPMENT WERE OVERSEAS
(EG IN USA).
4.
CLASH OF INTERESTS. UNDER PROPOSALS, OMNI/ARCO WOULD HAVE
A FINANCIAL INTEREST NOT ONLY IN CERTIFICATION AND LICENSING
BUT ALSO IN THE PROCEEDS OF FEES COLLECTED. AS THE MAIN BUSINESS OF THE PARENT COMPANY IS THE BUYING AND SELLING OF AIRCRAFT,
