CONTROL OF APPOINTMENTS UNDER COLONIAL REGULATION 19
1. We discussed last week, in the context of a problem over the appointment of an acting Chief Secretary, Turks & Caicos, whether or not the despatch of 8 September 1978 (copy attached) setting out the posts to be covered by CR19 might be deemed to cover acting appointments as well as
permanent appointments and promotions. I explained that this was the first time to my knowledge that the question had arisen, but agreed with you that it seemed right that acting appointments should be covered. Your subsequent discussions with Legal Advisers and within WIAD supported this view and telno 287 to Grand Turk (copy attached) issued.
2. It occurs to us that to avoid possible difficulties in
other DTs in the future we should now spell out in further despatch that acting appointments as well as permanent ones for all the posts designated originally are subject to the S of S's approval. If you think this would be a useful clarification I will check with SAmD (for the Falklands), SED (for Gibraltar) and SPD (for the New Hebrides) and then draft a series of short despatches appropriate to each DT. (except Bermuda and Belize, which were omitted for reasons of local sensitivities).
