I have again re-read Lord Goronwy Roberts' letter (since

Dr. David Owen did not sign it the action must be misconceived so far

as he is concerned) and I have wholly failed to find anything

defamatory in it. In fact, the letter says in terms that the Hong

Kong Government has carried out a thorough investigation of Mr.

Tung's allegations and have been unable to find any record of the case

he refers to. Nor indeed, did they find any record of any other charge,

let alone conviction, against him. The letter further points out

that his name and reputation in Hong Kong are unblemished.

In these circumstances I think we should now apply to have

the action struck out under R.S.C. Order 18 Rule 19 and under the

inherent jurisdiction as disclosing no cause of action and as being

frivolous and vexatious and an abuse of the process of the Court.

Statement of Claim and I should therefore be glad to have your instruc-

tions to proceed accordingly as soon as possible.
