TUNG -v- LORD GORONWY ROBERTS AND DR.DAVID OWEN

With further reference to this matter I write to let you

know that as instructed Iissued a Summons to strike out the action

as disclosing no cause of action. It was for hearing on Wednesday

21st March 1979 but in view of his ill health and his age, Mr.Tung

requested an adjournment which, after discussing the matter with the

Master, I have now agreed, with the result that the Summons is for

hearing on Monday 18th June 1979 at 10.30 a.m.

Although in a way it is irritating not to have the matter

disposed of, the Defendants suffer no prejudice, as our time for

service of Defence is extended until after the hearing of the Summons

which I suppose, for one reason or another, might yet never take

place owing to the Plaintiff's age and the fact that he now lives in

New York.

I will keep you posted as to developments.
