TEMPORARY RESTRICTION OF BUILDING DEVELOPMENT (MID-LEVELS)

(3) A failure to comply with any condition imposed under sub- section (2) shall be deemed to be, and shall be treated as, a contravention of the Buildings Ordinance; and any person who fails to comply with such condition shall, for the purposes of section 40(2B) of the Buildings Ordinance, be deemed to be carrying out or to have carried out building works, or authorizing or permitting or to have authorized or permitted such works to be carried out, in such manner as is likely to cause a risk of injury to any person or damage to any property.

4. (1) Section 15 of the Buildings Ordinance shall not apply to any building plans or in respect of any application for consent to the commencement of building works for or involving site formation, excava- tions, foundations, street works or any works relating thereto if the building works are to be carried out wholly or partly in the area specified in the Schedule.

(2) Where, after 12 noon on 22 May 1979 and before the enactment of this Ordinance, consent for the commencement of any building works for or involving site formation, excavations, foundations, street works or any works relating thereto is deemed to have been given by virtue of section 15 of the Buildings Ordinance and such building works are to be carried out wholly or partly in the area specified in the Schedule, such consent shall be invalid and have no effect.

5. The Governor in Council may, by order, amend the Schedule by substituting for the plan referred to therein a plan showing a smaller area of the Mid-levels area.

6. This Ordinance shall expire on 31 December 1981, unless con- tinued in force by a resolution of the Legislative Council.
