At Annex A, for the consideration of Honourable Members, is the Immigration (Amendment) (No 2) Bill 1979. This bill seeks to make the following amendments to the Immigration Ordinance (Chapter 115):

to provide for the detention initially up to 28 days but renewable by a court thereafter, of persons who are to be removed or deported from Hong Kong, in order that they may give evidence in Court or facilitate enquiries into any offence;

to remove the restriction on the size of vessel which may be forfeited as a result of offences committed under the Ordinance;

to give members of the Royal Hong Kong Regiment and the Royal Hong Kong Auxiliary Air Force the same powers to arrest illegal immigrants as are presently exercised by members of Her Majesty's forces;

to remove the restriction on the size of vessel which officers in command of Her Majesty's warships are empowered to board, search and detain in Hong Kong waters, and to provide officers in command of Her Majesty's auxiliary vessels with similar powers; and

to amend the definition of Immigration Assistant to include the newly created rank of Senior Immigration Assistant.

Some of these amendments arise from the need to have wider powers to deal effectively with illegal immigrants from China and refugees from Vietnam.
