differences between the children of British citizens

born in foreign countries and those born in

Commonwealth countries should be removed so far as

possible.

Because all British citizens will have the right of abode in

the UK, immigration consequences dominate most of the

consideration of nationality provisions. And because at

present the right to settle in the UK does not extend beyond

the second generation born overseas there is no chance whatso-

ever of transmission of citizenship in futre beyond the

second generation for citizens living overseas. We have

considered the following possibilities for transmission to the

second generation.

Child of Crown Servant becomes a British citizen by

birth.

Comment. This is proposed by Home Office; it is an

improvement on present position. At present the

child born overseas of a Crown Servant born in the

UK derives no advantage from his father's Crown

Service. It is only if the Crown Servant is a

citizen by descent that the Crown Service provision

comes into play..

A provision whereby the second generation born over-

seas could acquire citizenship after residing for

a specified period say 3 years

his parents.
