(iv) Accident Compensation

The accident compensation system will soon be augmented by the Traffic Accident Victims Assistance Scheme to be introduced in May 1979. This scheme will be administered by the Director of Social Welfare under the Traffic Accident Victims (Assistance Fund) Ordinance 1978. It will provide immediate cash assistance to victims of traffic accidents, irrespective of whether the victim was at fault or not. Payments will be based on the rates and criteria applicable to the Emergency Relief Fund, but will be subject to a refund should the victim subsequently receive common law damages or other forms of compensation in respect of the same accident. Appeals against the department's decision will be heard by the Social Security Appeal Board. The Government is also discussing with the Accident Insurance Association the establishment of a Motor Insurers' Bureau which will enable traffic victims to receive "full damages" in circumstances where he is unable to do so at present. Such compensation contrasts with the much smaller standard ex- gratia payments which will be made under the "no-fault" Traffic Accident Victims Assistance Fund. No further development of accident compensation is contemplated at this stage.

(v) Occupational Benefits

Occupational benefits provided by employers, either voluntarily or statutorily have a definite role to play in the social security structure. However, the Government does not see occupational benefits as playing a predominant role in the overall social security framework, but there should be room for improve- ments in these benefits in line with the general prosperity in Hong Kong and the rising aspirations of its people.
