THE MATRIMONIAL PROCEEDINGS AND PROPERTY (AMENDMENT)

ORDINANCE 1979

(No. 64 of 1979)

Before the enactment of this Ordinance, when a party to a maintenance order which had been made by a court subsequently petitioned for divorce, nullity of marriage or a judicial separation in another court it was not possible in Hong Kong for the court which was hearing the petition to direct that the order should cease to have effect. It was necessary for the party to return to the court which made the maintenance order and apply for the order to be cancelled before the court hearing the petition was able to make a fresh order. This Ordinance brings the law into conformity with that in the United Kingdom which empowers a court hearing a petition for divorce, nullity of marriage or a judicial separation to direct that a subsisting maintenance order shall cease to have effect.

Before the Governor assented to the Bill in the name and on behalf of Her Majesty, I advised that he could properly do so.
