4. I therefore think that we have good grounds for recommending to FCO Ministers that they should take up the policy issues with Mr Nott. I see no reason why FCO and DOT Legal Advisers should not get together first to see

if an agreed position can be reached on the question of vires. but that is not really a point for me.
