1. We spoke on the telephone about the reference in paragraph 1 of Hong Kong telegram No 1388 to 'a legal opinion from a specialist QC'. I said that it was clear from the subsequent description that this was an opinion sent to me by the Hong Kong Attorney-General last month. I explained that we had not copied this to you at the time because we had thought it to be identical with an opinion given to me by the Attorney-General on 7 August (my minute of 7 August to Miss Stoddart and Mr Aust's minute of 9 August to Miss Stoddare refer). Since we have not kept a copy of the document given to me in August I have been unable to check whether the two are in fact the same. But the date on the 'second' opinion, 2 August, is consistent with this possibility.

3. I enclose a copy of the opinion sent to me last month. You will no doubt want to consult your department's Legal Adviser.
