Nr Northover has passed on tol me your minute of 31 July I am sure it is helpful for you to keep up the pressure on the DOT on your own net. I have already made it clear to them that we need to know the answer to Mr Cortazzi's question and that in the meantime we
cannot agree to any substantive reply to Hong Kong about CPA's status at the CAA here. Mr Stables believes it is necessary to consult Mr Kerry, but as he is particularly busy at the moment this may take a few days. In the meantime we have sent a brief holding reply to Hong Kong.
We shall of course need to look at any legal arguments the DOT may put forward, but I agree with you that the point at issue may turn out to be one of policy rather than of law.
