1982.

1. ON 21 JULY GARDINER AND SULLIVAN HAD TWO DRAFTING SESSIONS WITH QIAN ZEMIN OF CAAC TO CLEAR UP THE OUTSTANDING DIFFERENCES IN THE TEXT OF THE AGREEMENT AND OF THE TWO CONFIDENTIAL MEM- OR ANDA OF UNDERSTANDING COVERING THE TRUNK ROUTE AND REGIONAL

ROUTES.

2. SINCE THE REGIONAL ROUTES ARE NOWHERE REFERRED TO IN THE AGREEMENT, A PARAGRAPH WAS INCLUDED IN OUR DRAFT CMU ON THE REGIONAL ROUTES WHICH WOULD APPLY THE TERMS OF THE AGREEMENT

(WITH THE EXCEPTION OF ARTICLES 17,18 AND 19 WHICH DEAL WITH AMENDMENT, TERMINATION AND ENTRY INTO FORCE) TO THE REGIONAL

ROUTES.

3. QİAN EXPLAINED THAT THIS PARAGRAPH WAS NOT ACCEPTABLE TO THE CHINESE SIDE, SINCE THE REFERENCES TO TERRITORY'' IN THE AGREEMENT AS APPLIED TO THE REGIONAL ROUTES, WOULD CARRY THE CLEAR IMPLICATION THAT HONG KONG WAS BRITISH TERRITORY. HE WAS UNMO VED BY THE ARGUMENT THAT WE HAD UNDERSTOOD THIS DIFFICULTY AND HAD THEREFORE AGREED THAT THE REGIONAL ROUTES AND THE INCLUSION OF HONG KONG ON THE TRUNK ROUTE, SHOULD NOT BE INCLUDED IN THE AGREEMENT, BUT BE THE SUBJECT OF SEPARATE CMUS, IN WHICH REFERENCES BACK TO THE AGREEMENT SHOULD NOT CAUSE PROBLEMS AS THEY WERE CONFIDENTIAL.
