IT IS THE VIEW OF ICAO THAT DCA HONG KONG IS EXCEEDING HIS AUTHORITY IN HONG KONG NOTAM A269. DANGER AREA D4 AS DEFINED BY CHINESE DOES NOT REPEAT NOT IMPINGE ON AIRWAY AND REASONING IN PARA 1 OF TELEGRAM 1588 INDICATED THAT DCA IS EFFECTIVELY EXTENDING ITS EXTENT BEYOND 00-ORDINATES GIVEN BY CHINESE THEMSELVES.
2. TEL NO 1481 OF 24 OCT. IT IS NOT FOR DCA TO DETERMINE STANDARDS OF AIR SAFETY APPLIED BY NON-HONG KONG AIRLINES BUT TO PROVIDE AIR TRAFFIC SERVICES OVER HIGH SEAS IN ACCORDANCE WITH INTERNATIONALLY AGREED ICAO REQUIREMENTS. HAVING DRAWN ATTENTION TO CHINESE DANGER AREAS IT IS THEN FOR AIRLINES IN ACCORD WITH THEIR OWN NATIONAL OPERATIONAL REQUIREMENTS TO DETERMINE WHETHER OR NOT THEY CAN OPER- ATE SAFELY OVER HIGH SEAS.
3. PRESIDENT ICAO HAS TOLD ME IN CONFIDENCE THAT HE HAS SOME CORROB- ORATION THAT CHINESE AIM IS TO USE REALIGNMENT OF AMBER ONE TO GAIN INTERNATIONAL RECOGNITION OF THEIR CLAIM TO PARACELLS. THEY WOULD BE UNLIKELY TO OBTAIN THIS THROUGH NORMAL OPEN ICAO PROCEDURES. IF HONG KONG SPONSORS THE OPENING UP OF THE REALIGNED ROUTE IT PUTS U.K. IN POSITION OF ENDORSING, THROUGH ICAO, THE CHINESE CLAIM TO SOVEREIGNTY.
4. IF ICAC REP BANGKOK AGREED EITHER OF THE POINTS MADE IN PARAS
1 AND 2 ABOVE THEN HE EXCEEDED HIS INSTRUCTIONS. IATA REPRESENTATIVE AT MEETING 18 OCTOBER IS KNOWN TO HAVE EXCEEDED HIS INSTRUCTIONS ON POINT IN PARA 2 ABOVE AND DG/IATA IS REPRIMANDING HIM.
