Negotiations with governments whose territories lie
within the accepted regional area as defined in
paragraph 11 above. In these talks it is considered
that endeavour must be made to obtain for CPA : (a) equal treatment with the foreign carrier on
third and fourth freedom sectors;
(b) fifth freedom rights from the foreign governments

or equivalent value to those granted by HMG to
foreign carriers into and out of Hong Kong on
regional routes.
Negotiations with governments whose territories lie
outside the regional area. It is considored that the policy, subject to paragraph 15 below, should be not
to grant to foreign operators fifth freedom rights
into or out of Hong Kong, in respect of sectora on
which an adequate service is, or will shortly be
operated by CPA.

It is appreciated that the above principles may have to be modi-
fied to some extent when the imperial interests of BOAC conflict with those
of the regional carrier, but such modifications should not be entirely to
the detriment of CPA. It is in these cases that full discussion and agree-
ment between the British negotiators and the Hong Kong representatives is
of paramount importance.

The position of the Hong Kong representative (normally the Director of Civil Aviation) vis a vis the British delegation as a whole, at air
services negotiations, is one of some difficulty, and clarification of his
status, and right to be heard appears desirable. This is particularly the
case when Her Majesty's Government is negotiating on behalf of both BCAC
and CPA and has to take into consideration the interests of both, although
thescmay be conflicting. In such circumstances, it is suggested that
certain guide lines should be laid down, within which the delegation as a
whole should work.
