in respect of each specified route must be established in

accordance with Article 7 of that Agreement and will apply

in respect of services operated by the designated carriers

on the specified route. Approval of the proposed tariff

has not been given by the aeronautical authorities of the

United Kingdom,

CPA is a carrier designated for Kuala Lumpur-Hong Kong and

is entitled under Article 5(1) of the Agreement to enjoy

fair and equal opportunity in the provision of services on

the specified route. Thus, it is the view of Her Majesty's

Government that if a particular fare is established, CPA is

entitled to employ that fare on the same conditions that

apply to MAS. If CPA is not permitted to use that fare,

then the fare will not be available for any carrier on the

route as the tariff will not have the approval of the

aeronautical authorities of both Contracting Parties as

required by Article 7 referred to above.
