We would now like the formal views of the FCO about this. If it was your view that we should relax this prohibition you may well wish to return to the charge with Hong Kong on this issue. It is our view that it might be better to have no formal amendment of Section 5 to remove the prohibition since this would have to be filed with ICAO and become general knowledge. If we were to remove the pro- hibition, it might be better to enter into an agreement with the Americans by a confidential exchange of letters that we would no longer enforce the terms of the prohibition.
I hope this gives you sufficient to enable you to review the situation fairly quickly so that we can hope to give a substantive reply one way or the other to the Americans before our next round of talks.
