Short title and commencement.
Amendment of section 2.

Amendment of section 27.
Amendment of section 38.
Addition of new sections 38A. 38B and 38C.
Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
1. This Ordinance may be cited as the Merchant Shipping (Amend- ment) (No. 2) Ordinance 1979 and shall come into operation on a day to be appointed by the Governor by notice in the Gazette.
2. Section 2 of the principal Ordinance is amended in the definition of "Merchant Shipping Acts" by deleting "1960" and substituting the following-
"1979".
3. Section 27 of the principal Ordinance is amended by deleting subsections (3), (5) and (6).
4. Section 38(3) of the principal Ordinance is amended by deleting ", and the International Convention for the Safety of Life at Sea, 1948,".
5. The principal Ordinance is amended by adding after section 38 the following sections--
"Power to make regulations to give effect to International Convention for the Safety of Life at Sea 1974.
38A. (1) The Governor in Council may make such regulations as he considers appropriate to implement the provisions of the International Convention for the Safety of Life at Sea 1974, so far as those provisions are not implemented by or under any provision of the Merchant Shipping Acts as extended to the Colony or by or under this Ordinance.
(2) Without prejudice to subsection (1) the Governor in Council may make regulations with respect to ships provided with nuclear power plants for the purpose of enabling effect to be given to the provisions of Chapter VIII of the Annex to the International Convention for the Safety of Life at Sea 1974.
(3) For the purposes of subsections (1) and (2) and without prejudice to the generality of the powers contained therein the rules (including the nuclear ship rules) made from time to time under the Merchant Shipping Acts implementing the International Convention for the Safety of Life at Sea 1974 shall, unless varied by or repugnant to the regulations made under this section, be deemed to be regulations made under this section.
