EXECUTIVE COUNCIL DECISION OF 9.1.79

The Council considered memorandum XCC(79)7.

The Council ADVISED and the Governor CRDFRED:

that the Merchant Shipping (Amendment) Bill 1979, the Shipping and Port Control (Amendment) Bill 1979 and the immigration (Amendment) Bill 1979 should be published and introduced into the Legislative Council on 10th January 1979, subject to the following:

(a) Merchant Shipping (Amendment) Bill 1979

(i)

that the penalty in section 34 be increased to 4 years, ch conviction before the District Court or the High Court;

(ii) that the Attorney General's

consent be required before proceedings for forfeiture of a ship are instituted under the proposed section 34A;

(iii)

that all the amendments should cease to have effect at the end of December 1979 unless the Legislative Council extends the life of the provision by means of a resolution.

(b) shipping and Port Control (Amendment)

Bill 1979

that the maximum penalty under both section 72 and the proposed section 72A be increased to a fine of $200,000 and imprisonment for

4 years on conviction before the District Court or High Court,

(c) Immigration (Amendment) Bill 1979

that the amendment should cease to have effect at the end of December 1979 unless the Legislative Council extends the life of the provision by reans of a resolution.
