Kuala Lumpur telegram No 234 reports that the Secretary of State discussed this subject with Sir M MacLehose and Mr Cradock during his visit to Hong Kong, and now wishes to send a minute to the Prime Minister for her to see on her return.
2. I have discussed the draft in Kuala Lumpur telegram No 235 with Mr Rushford and with FED. I submit a clean text incor- porating four minor changes:-

a) I have inserted "of Hong Kong" after "the Governor"
in the opening line.
b) The third sentence of the fourth paragraph now reads
"The Order would not have to be laid before Parliament" (instead of "The Order would not require an affirmative vote in the House of Commons"). This is in fact the
case.
c) The opening of the penultimate paragraph has been
amended to read "If the Chinese do not object to what is proposed, we should make [instead of "lay"] the Order in September.....". This change follows from the previous one.
d) In the same paragraph "Council" has been inserted
after "
... in the Governor's Legislative......"
As an Order in Council is involved, I recommend that the minute should be sent to the Attorney-General as well as to the members of OD (we are in touch with senior officials in the Law Officers Department who will brief him on what is involved). I have made a consequential amendment to the final paragraph of the minute.
