1. These disciplinary procedures are designed to help ensure that the standards of conduct laid down for civil servants (see Code 9870- 9999) are observed, by providing a fair method of dealing with alleged offences, and encouraging improvements in individual conduct.

GENERAL

2. The Staff Side of the National Whitley Council have the right to make representations on procedural matters and on general principles underlying disciplinary action. Disciplinary action in individual cases is a matter for management, although an officer has the right to the assistance of a colleague (who may be his trade union representative) as set out at paragraph 5 below.

There is no rigid code automatically assigning particular penalties to particular offences.

The treatment of a disciplinary offence will be affected by the circumstances of the department and of the particular case. But except for gross misconduct, no officer will be dismissed for a first disciplinary offence, nor dismissed without notice.

MINOR OFFENCES

4. Relatively minor offences may be dealt with on the spot by line management by informal oral warning. But if an officer's conduct does not improve after an oral warning (or warnings) the officer may be given a written warning by line management stating the conduct complained of and if appropriate what specific improvement is required. A written warning will state that any further misconduct of the type complained of may need to be considered under the formal disciplinary procedures and may call for a penalty within the terms of paragraph 8 below.
