ICAC AND THE AMNESTY

1. We have received a copy of GIST (Hong Kong Government Review of the Chinese-Language Media) dated 20 December 1977. The main article deals with ICAC and the impact of the recent amnesty.

2. The article reports, in particular, that ICAC had had to drop 83 investigations as a result of the amnesty.

3. This conflicts with out general interpretation of how the amnesty should work; one of the categories specifically excluded from the amnesty was that of cases in which allegations of corr-

uption had been made before 5 November 1977.

4. As the continuing effectiveness of ICAC is sure to come under scrutiny both here and in Hong Kong, I recommend that Mr Stewart should write to the Governor asking him to clarify the matter and
