Objection from Messrs Fairbairn, Kwok and Wong on behalf of Oriental Enterprises Company Limited (Annex G)

The company, which owns Survey District 1 Lot No 577/3 Remaining Portion having an area of 539,7 m2 (5, 790 square feet), objects to the proposed road widening and requests that compensation be paid for loss of land and business.

As the lot in question is restricted to agricultural use the company is not entitled to claim for business loss under section 10(2)(d) of the Crown Lands Resumption Ordinance and compensation for loss of land will be paid at the prevailing rate for agricultural land. The company will also be offered ex-gratia allowance by the Housing Department under the existing policy subject to the eligibility criteria being satisfied. Accordingly, it is recommended that the objection should not be upheld.

In connection with the proposed roadworks, it is necessary to acquire several sections of Lot No 577/3 in Survey District 1. The remaining Portion, section B, section A sub- section 1 and section A sub-section 2 are directly affected by the proposed road widening, while section C, section A sub-section 3 and section A (Remaining Portion) are included because there are several old two storey stone buildings erected upon the site which straddle the lot boundaries as explained in paragraph 17 above. The sections of Survey District 1 Lot No 577/3 required to be resumed and listed above are shown coloured beige on the plan No KM1610 at Annex H.
