boundary walls are affected. Where the existing walls are constructed of specialised building materials such as decorative stone, it is intended that the Government contractor will demolish and rebuild the walls on the new building lines using the original materials as far as possible. In all other cases, a new wall will be constructed by the Government contractor prior to demolition of the existing one.

Attempts to acquire the land by negotiation having failed, the only recourse is resumption under the Crown Lands Resumption Ordinance there being insufficient time before works are due to start on the land to resume under the provisions of the Crown leases.

Recommendation

It is recommended that the portions shown coloured beige hatched black on the plan at Annex D of the lots described in Annex E should be resumed under the Crown Lands Resumption Ordinance.

Honourable Members will be asked to advise:

(a)

under section 6 of the Streets (Alteration) Ordinance (Chapter 130), whether the proposed roadworks illustrated on the plans at Annex A should be authorised to proceed without modification; and

under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether resumption of the portions shown coloured beige hatched black on the plan at Annex D of the lots listed in Annex E is necessary for a public purpose, namely, construction

of the Cornwall Street/Waterloo Road/Junction Road

Grade Separated Intersection.

(The Deputy Secretary for the Environment (Mr G. BARNES) and the Principal Government Highway Engineer (Mr S.A. BARDEN) will attend before the Council for the discussion of this item).
