(SUPPLEMENTARY RESUMPTION)
On 29th November 1977, having considered memorandum XCR(77)312 (Annex A to XCRI(78)3), Honourable Members advised and the Acting Governor ordered, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), that the resumption of 238,3 m2 2 of land at Hung Mui Kuk, Sha Tin, shown coloured orange on the plan
(Annex B to XCRI(78)3), was necessary for a public purpose, namely construction of the Hung Mui Kuk Interchange.

The Council also recommended that the owner should receive compensation of "not less than the amount that he had paid for the land", and asked for an information note indicating how much this would be.

Compensation payable under a resumption order is deter- minable under sections 10, 11 and 12 of the Crown Lands Resumption Ordinance. Section 10(2)(a) provides that compensation (if any) should be determined on the basis of the value of the land resumed and of any buildings erected thereon at the date of its reversion to the Crown.

In 1974, when the site (311, 837 square feet) was granted by Letter B exchange to the owner, he paid a total premium to the Government of $4,911, 621,50. This amounts to $15.75 per square foot.

At this rate (15.75), the "value" of the area of land to be resumed (238.3 m2) would be $40, 398, 75.

However, if the costs of the Letter B entitlements, with which the owner acquired the land, are also taken into account, the unit land cost of the whole site would be $28.60 per square foot and a pro rata figure for the land to be resumed would be $73, 359.
