RESUMPTION OF LAND FOR STAGE IIA DEVELOPMENT AREA 28N, TUEN MUN NEW TOWN, TUEN MUN, NEW TERRITORIES

Engineering works in Area 28(North), Tuen Mun New Town, form part of the New Town stage IIA development under packages 14 and 18 which are in Category A of the Public Works Programme. Package 14 involves mainly reclamation in Areas 28 and 44 of the New Town, together with some roadworks and construction of the main breakwater for the typhoon shelter. Package 18 provides for the formation of Areas 3, 8 and 51 with any excess fill material obtained being used for reclamation in Area 28 (North). After site formation works are complete, Area 28(North) will be developed for public housing. The acquisition of certain private agricultural land in Area 28(North) is necessary if site formation is to proceed as scheduled.

The Director of Public Works has accordingly requested the resumption of 4, 832 square metres (about 52,011 square feet) of agricultural land in Area 28(North), Tuen Mun New Town. The general location of the land to be resumed is shown coloured orange on the identification plan at Annex A. The Secretary for the New Territories is satisfied that the area to be resumed is the minimum necessary to implement this project. Compensation for resumption and clearance is estimated at $1.873 million and this commitment will not result in the approved project estimate being exceeded nor will it exceed the financial provision for 1978-79. Ex-gratia domestic removal allowance and ex-gratia allowance for one industrial and one commercial under- taking will be paid from the compensation vote of the Housing Department under which funds are available.

The clearance will cover both Crown land and private land and involves payment of compensation for crops, fruit trees, wells, irrigation sumps and fences, together with ex-gratia allowance for cultivators and ex-gratia disturbance allowance for displaced poultry farmers.

Twelve (12) temporary structures on Crown land used for domestic purposes will have to be cleared. These structures are occupied by nine (9) families who, if found eligible, will be offered public housing in Tuen Mun. Families not eligible for public housing will be
