Fifty-two (52) temporary structures (34 on private land and 18 on Crown land) used for domestic purposes will have to be cleared. These domestic temporary structures are occupied by thirty-eight (38) families who if found eligible, will be offered public housing locally. Families not eligible for public housing will be offered space in a temporary housing area in Tuen Mun. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these families. Genuine cultivator-families who are eligible for public housing but who opt to continue cultivation elsewhere will be offered an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the domestic temporary structures mentioned above, a total of 271 other temporary structures including shops, workshops, pigsties, chicken sheds and duck sheds will also have to be cleared. The cost of ex-gratia allowances for 2 commercial and 9 industrial undertakings is estimated at $204, 000 and will be paid from the compensation vote of the Housing Department under which funds are also available.

The institution of formal resumption proceedings is recommended as a safeguard in the event that agreement cannot be reached with landowners for voluntary surrender of their land and in order to avoid delays which may be caused by succession difficulties and absentee landowners, Engineering work is scheduled to begin on Crown land in late May 1978, therefore, two months' notice of resumption is recommended. As the land to be resumed lies within the Tuen Mun Outline Development Plan, owners of agricultural and building land will be offered, subject to there being no change in current policy, the alternative of land exchange entitlements on Letter B terms or cash compensation. The amount of cash compen- sation to be paid out will be reduced to the extent that land exchange entitlement are taken up.

Honourable Members will be asked to advise, under, section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely site formation in Area 51 in connection with Tuen Mun New Town engineering development stage IIB, package 18 works.
