The clearance will affect both Crown land and private land and will involve payment of compensation for crops, pine trees, fruit trees, flowers and bamboos, as well as ex-gratia allowance for cultivators and ex-gratia disturbance allowance for displaced pig- breeders and poultry farmers. Payment of compensation for the removal of fences, gates, wells, pumphouses, water tanks and pipes together with Tun Fu Ceremony fees will also be necessary.

Two (2) temporary structures on Crown land used for domestic purposes will have to be cleared. These temporary structures are occupied by two families of about twelve (12) persons who, if found eligible, will be offered either public housing or space in a temporary housing area. Families not eligible for public housing will be offered spaces in a temporary housing area. Ex-gratia domestic removal allowance of up to $1,000 per family may be payable to these displaced families, Genuine cultivator-families who opt to continue farming elsewhere may be eligible instead for an ex-gratia rehabilitation allowance of $5,000 per family but will forfeit their priority for public housing.

In addition to the domestic structures mentioned above, a total of 33 other temporary structures, including a shop, pigsties, chicken sheds and agricultural stores will also have to be cleared. The cost of ex-gratia allowance for the shop is estimated at $12,000 and will be paid from the compensation vote of the Housing Department under which funds are available.

Negotiations to obtain voluntary surrender of the private land are in progress but the institution of formal resumption pro- ceedings is recommended in order to avoid delays which may be caused by absentee landowners or succession difficulties. In order that engineering works can proceed on schedule, possession of the land is required in November 1978. Accordingly, two months' notice of resumption is recommended.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the resumption of the lots listed at Annex B is required for a public purpose, namely Clear Water Bay Road improvements, Stage II, phase 1 (Pik Uk to Clear Water Bay Apartments), Sai Kung, New Territories.
