Thank you for letting me know of your coming interview with John Roper, M.P. I have asked F.C.O. to copy to you our recent correspondence on the subject of repatriation of illegal immigrants from China. (My telno. 1260 of 15 December 1977 refers.) I hope you will find

them useful.

We are, of course, following scrupulously the ground rules agreed with the F.C.0. in 1974 as a condition for returning illegals. These did not include access to a We lawyer (though we know this is the procedure in U.K.). have not been asked by the F.C.O. for our views on the suggestion that lawyers should be present and I hope this means that it is not being pursued by John Stewart. Certainly the suggestion was greeted with some surprise here by the Press.

Individual illegals have petitioned to remain and their case is considered before any final decision is taken to return them. There have also been one or two cases of habeas corpus and, of course, these too are dealt with before the illegal is returned. pay particular attention to each case. you informed of further developments but our policy is to continue to operate this scheme according to the rules. It is very much in Hong Kong's interest that this should

be so.
