VI. CONTRACTS OF EMPLOYMENT AND
THEIR TERMINATION
Contracts of employment
6.1
On form, an employment contract in Hong Kong may be made either orally or in writing. All other countries adopt the same practice, except Malaysia where a contract must be in writing if the specified period exceeds one month. In Indonesia only contracts for plantation
workers and for workers recruited from other
provinces need to be in writing.
6.2
As regards the duration of contracts,
any contract for a period exceeding one month in Hong Kong is deemed a month-to-month contract unless it is evidenced in writing signed by the parties concerned. There is no legislation in Malaysia, the Philippines, Singapore and Thailand concerning the duration of contracts generally. But in Korea a contract must normally not exceed one year while on the other hand Indonesian employment contracts are considered to be for indefinite periods unless otherwise specified.
Termination of employment
6.3
Most of the territories including Hong Kong have legislation regarding the period of notice for termination of employment. One month's notice or payment in lieu of notice is common in Hong Kong and Korea. In Malaysia and Singapore
