In Indonesia and Korea there is no minimum

period of service before the female employee is entitled to maternity leave. In Malaysia the minimum period of service is 3 months. In other territories (Hong Kong, the Philippines, Singapore and Thailand) about 6 months service is the general

standard.

On pay entitlement, an employee on maternity leave in Hong Kong is not paid unless the employer so agrees. But in other countries full pay is granted for the whole period of leave, except in Thailand where only half of the maternity period is paid leave.

An interesting limitation exists in

Malaysia, Singapore and the Philippines where maternity leave with pay applies only to the first 3 surviving children, the first 2 surviving children and the first 4 deliveries, miscarriage or abortion

respectively. This is a deliberate attempt to

restrict the size of families.

4.17

A common feature in all the territorias

including Hong Kong is that termination of employment of the female employee whilst on maternity leave is expressly forbidden by law.
