IV. HOLIDAYS, REST DAYS AND MATERNITY LEAVE

Statutory holidays with pay

4.1

With 10 paid statutory holidays every year, Hong Kong is on a par with the Philippines. Other countries which have more holidays are Indonesia and Singapore (both 11), Thailand (13) and Korea (16). Malaysian workers have the fewest

statutory holidays with pay 7 a year.

4.2

Except for Hong Kong where continuous

employment of three months is a pre-condition, employees elsewhere are entitled to statutory holidays with pay immediately upon employment. In the case of Hong Kong, Malaysia and Singapore, any other days may also be substituted for these holidays by mutual agreement between the employer and the employee. Except for Hong Kong, all territories permit payment in lieu of holiday.

Annual leave with pay

4.4

The duration of paid annual leave varies from country to country. Hong Kong legislation provides for a flat rate of 7 days (all of which must be consecutive or, if the employee so requests, at least 4 consecutive days) to all manual workers and non-manual workers earning $2,000 or less per month who have completed 12 months of employment. A flat rate is also adopted in Indonesia (12 days of which 6 must be consecutive), the Philippines (5 days) and Thailand (6 days).
