Comments
The public authorities, employers' and workers' organizations, and institutions or bodies providing education and training shall be associated, in a manner appropriate to national conditions and practice, with the formulation and application of the policy for the promotion of paid educational leave.
The Labour Advisory Board which consists of representa- tives from major employers' associations and workers' representatives elected by trade unions will advise on the formulation and application of the policy for the promotion of paid educational leave, while the Hong Kong Training Council which maintains regular contact with technical institutions will advise on the training courses to be offered to enable workers to utilise such leave.
The financing of arrangements for paid educational leave shall be on a regular and adequate basis and in accordance with national practice.
Paid educational leave shall not be denied to workers on the ground of race, colour, sex, religion, political opinion, national extrac- tion or social origin.
Government's policy is that industry should bear the cost of practical training for its own staff and Government will provide the necessary related technical education facilities.
Trade unions are weak and financially unable to finance such leave.
It therefore appears that the employers would have to shoulder the cost of paid educational leave in accordance with the proposal at Article 1.
Apart from the legislation which is specifically designed to protect women and young persons, all labour legislation is generally applied to all workers as a whole. Any law on paid educational leave would be no exception.
