4. The amendment in clause 9(a) gives the general manager power to make railway rules regulating the work and conduct of railway em- ployees and the amendment in clause 10 provides that the general manager may impose the punishment provided in the railway rules if any railway employee commits a breach of the railway rules. The disciplinary powers of the general manager will not apply in relation to railway employees above the ranks specified in the Second Schedule in clause 16 by virtue of section 31(6) of the principal Ordinance. Clause 9(b)(ii) also gives the general manager additional powers to make regulations with the approval of the Governor in Council to secure the proper control of persons using the railway and the payment of fares.

一九七八年鐵路(修訂)法案

摘要說明

本法案之主要目的,在將鐵路條例之名稱改為「九廣鐵路條例」,並 將提及「管理人」、「鐵路」及「鐵路人員」之處去而分別代之以「鐵路局長」、 「該鐵路」及「鐵路僱員」。本法案規定委任鐵路局副局長。上述修訂及其他相應 之修訂,載於法案第二條、第三條(b)款、第六、第十七及第十八條及附表內。

茲並藉此機會將原有條例之若干條文修訂,使之切合時宜(見法案第三

條(a)款、第四、第五、第七、第十二及第十三條),但並非重大更改。

三、 法案第八條、第九條(b)款第(i)段、第十四及第十五條將原有條例中某 等不復需要之條文撤銷。法案第十一條所撤銷之各條規定,將在根據該條例制訂之 規例內出現。

四、 法案第九條(a)款所作之修訂,賦給鐵路局長制訂鐵路規則之權力,以便 對鐵路僱員之工作及行爲加以管制。法案第十條所作之修訂規定:如任何鐵路僱員 觸犯鐵路規則,鐵路局長可按照鐵路規則所規定之罰則,加以懲處。根據原有條例 第三十一條第(6)款,鐵路局長之紀律處分權力,對法案第十六條內第二附表所規定 之職級以上之鐵路僱員不適用。法案第九條(b)款第(ii)段並賦給鐵路局長制訂規例 之額外權力,以求對使用鐵路之人士及繳付車費方面作適當之管理。該等規例,須 由總督會同行政局批准。
