Hong Kong Mass Transit Railway Corporation

I am not sure whether you are the appropriate person to whom I should write regarding a problem that we are facing on the Conditions of Contract on the extension to the Hong Kong Mass Transit Scheme. You have, however, been so helpful in other matters that I am seeking your advice directly or for an indication as to whom I might address this problem.

The customer has made it a Condition that, should there be an imposition or increase of any import duties or similar levies in Hong Kong during the currency of the Contract, then the supplier would have to bear this.

We know that our Japanese competitors have accepted this Clause and I also have reason to believe that some other competitors may have done likewise. The Clause is quite iniquitous but the customer has merely stated that if we think that there is a risk, then we should price for it.

The general information seems to be that it is highly un- likely that after so many years the Hong Kong Government
