Background

The Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Chapter 276) was enacted in 1974 and incorporated in one enactment:

(a)

(b)

the statutory powers required to facilitate the building of the Mass Transit Railways, including the power to resume land and create easements; and

provision for compensating for loss or damage arising from the exercise of these powers.

This Ordinance encompasses all matters pertaining to land affected by the construction of the Mass Transit Railway and, indeed, experience to date has shown that it has enabled quick action to be taken on land acquisition and related problems and in respect of compensation claims arising from the present construction of the Modified Initial System (MIS).

The Mass Transit Railway (Land Resumption and Related Provisions) (Amendment) Bill 1978, a copy of which is at Annex A, seeks to amend the principal Ordinance in three aspects, namely:

(a) the extension of the MIS to Tsuen Wan;

(b)

the procedure for the settlement of certain claims; and

the obtaining by the Government of expert advice on matters related to claims.
