Dear Mr. Lightman:

As an aide memoire to you, I list the following salient dates and events concerning the matter raised in your letter to me of 13 January, 1978:

Mid 1973/Mid 1974 Charles Brand & Son Limited undertook various trials under a contract with the provisional Mass Transit Railway Authority. A condition of carrying out this work for the Authority was that Charles Brand was precluded from tendering for construction contracts for three years.

In June 1975, the Mass Transit Railway Corporation, concerned at the lack of British Contractor interest in their projects, lifted their ban upon the companies within our Group and through their Consulting Engineers - Freeman Fox

- Freeman Fox - approached Kier.

As a result of this approach, we submitted tenders in respect of Contracts 201, 202 and 203.

In September 1975 our representatives went out to Hong Kong. At a meeting they were informed that we would be awarded Contract No.201.

· our Our representatives then left Hong Kong to make various arrangements requested of them by the Mass Transit Railway. They were asked to return to Hong Kong in mid-September when they were informed that we would not be awarded Contract No.201 but they would like to award us the smaller contract No.202 if we reduced our price by $10 million Hong Kong Dollars (- about £1 million) on a job of approximately £12million.
