1. We spoke on the telephone this morning about the problem of de-monetising the 50 cent coin in Hong Kong.
2. Mr Rushford, our Legal Adviser, has advised me:
) that the legal advice contained in Mr Candler's
letter of 10 July is correct
b) that he can see no reason why the coinage in
Hong Kong need be regulated by Order in Council under the Royal Prerogative.
He therefore recommend that we should invite the Governor to arrange for the enactment of a suitable Coinage Ordinance by local legislature and revoke the 1936 Order, which currently governs the Colony's coinage, with effect from the date on which the new Ordinance comes into operation.
3. I presume that if we Bllowed this advice the new Hong Kong Ordinance would be so worded as to side-step the immediate problem of de-monetising the 50 cent coin.
4. I wȧld be most grateful for the Treasury's views on this proposal.
