HONG KONG COINAGE

Prior to your lawyers drafting the necessary Amendment Order, you asked me to show the attachment to my letter of 18 October to the Treasury Solicitor for any comments he might have.

I have now done this and am advised that the following amendments should be made:-

i. in article 1 of the Order the citation should be to the Hong Kong

(Coinage) (Amendment) Number 1 Order 1978;

ii. in article 2 the words "as amended (b)" should be added after

"11936 (a)";

iii.rather than re-draft the whole of article 2 of the Principal Order, article 3 should state simply that for the words "all or any of the coins referred to in the Schedule to this Order" shall be substituted the words "any coin which is legal tender in the Colony".

I am afraid that the Treasury Solicitor has been unable to put his finger on the reference which should appear as footnote b but has said that your lawyers would probably be willing to find this. The Solicitor has also referred to the need for an Interpretation Clause, along the lines of article 2 (2)of the 1975 Order), but here again I suggest that you seek your lawyers advice on this.
