A consultation was held in Brussels on 8 December 1978 between

a Commission delegation and a Hong Kong delegation as provided for

in Article 13 of the EEC/Hong Kong bilateral Agreement initialled on

3 December 1977.

I.

Classification

Three definitions

Following a request earlier in the year from the Hong Kong authorities

for definitions for the following products :

(a)

industrial and occupational clothing

(b) track suits

(c)

trousers

the Community representative tabled the three texts which had been agreed in principle by the C.C.T. Nomenclature Committee and which, subject to editorial changes, would serve as basis for C.C.T. Explanatory

Notes. He recalled that definitions (a) and (b) had already been shown to the Hong Kong authorities and that their comments had been taken into

account.

As regards definition (c), the Community representative said that the Community was now prepared to accept a narrower concept for trousers which, in effect, would mean that certain garments having bibs and braces. would in future be regarded as overalls i.e. working clothes of cat. 76 or as "other outer garments" of cat. 81. This could entail a transfer of trade to categories not subject to restraint, especially for one parti- cular Community region, and recourse to Article 6 of the bilateral Agree-

ment could thus not be excluded.

The Hong Kong representative confirmed that definitions (a) and (b) were now acceptable subject to two suggested minor amendments on (b).

On definition (c), Hong Kong, whilst agreeing with the sense of the proposed description, proposed a positive identification of the product in question, rather than a negative formulation focussing on garments which would not satisfy the new criteria.
