Noto (2) It appears that the award of points under these

two aspects is pre-determined under paragraph 13 of memorandum XCC(76)77. Whether this means that all 10 points are to be awarded to 1.0.1. and none to Du Pont I have loft to the Special Tender Board to decide as this matter is cutside my competence.

Note (3) Neither tenderer would commit himself to a defined

basis for pricing of his product and I have accordingly awarded no points for this aspect. the event there is likely to be a significant difference in the usor price depending on which company manufactureros (paragraphs C11 and C18 refer). Bearing this in mind the Board may consider it appropriate to award points accordingly. A list showing current retail prices of commercial explosives and accessories in Hong Kong is attached.

Should it be decided that no points may be awarded under aspect (h), Product price, to either tenderer and should it be determined that I.C.I. are awarded 5 points under (d), Security, and 5 points under (e), Political, with the American company scoring nil under these aspects, then the final outcome would be I.C.I. 69 points and Du Pont 64.5 points with I.C.I. being the successful tenderer. In such circumstances it is my opinion that the award of the tender on this basis would mean that Hong Kong is obtaining the second best explosive product and most probably at a higher prico to the consumer.
