BRUNEI: JUDICIAL MATTERS

1. At the talks on 19 June the Sultan requested the continuation (after signature of the Treaty of Friendship and Cooperation) of the present arrangements whereby Judges from the Hong Kong Supreme Court are made available to staff the High Court and the Court of Appeal of Brunei (brief at Annex). He also sought to preserve the arrangement by which appeals lie from Brunei courts to The Queen in Council.

2. The draft Exchange of Letters on these matters, which was agreed with the Bruneis, is at Flag B. The approval of Her Majesty The Queen must be sought, for the proposal concerning Her Majesty's Privy Council.

3. I submit a draft submission by the Legal Adviser for this purpose, from the Secretary of State, and a covering letter from the Private Secretary to the Private Secretary, Buckingham Palace.
