Please refer to your letter of 7 June and our telegram No. 742 of 16 June. We have now received circular despatch GNT 401/1, "Protocol Amending The Consular Convention With Poland". It's actual terms do not cause us any difficulties. No legislation is required here, since we shall be able to deal with the requirements of the convention, should the need arise, by administrative means.

I hope, however, that the need will not arise. I remain worried about the loophole which apparently allows the Polish Consul-General to visit Hong Kong contrary to our general policy of trying to keep the Russians and East Europeans out. What are the prospects of excluding Hong Kong (either by itself or with other dependent territories) from the limits of his consular district which, I see, were to be determined "by agreement" under Article 3(2) of the Consular Convention? there any possibility of bringing consular arrangements with Poland in line with those already made with other East European countries when the amended convention enters into force?

In his letter to Alan Donald of 30 September 1976 Derek Milton implied that there might be some possibility of limiting the consular jurisdiction of the Polish Consul-General when a new appointment is made. Perhaps you could also look at this possibility. Incidentally, according to that letter, in 1976 the term of office of the then Consul-General, Kalinowski, was due to expire in 1977. We have heard nothing about any successor, but presumably one is due to be appointed soon and we will be consulted about gazetting him here, in line with para.4 of Milton's letter.

We should, of course, only wish the matter to be raised with the Poles if we could be certain of being able to secure their exclusion from Hong Kong. Otherwise, we risk alerting them to an opportunity which they have pot yet exploited. In any case I assume you would consalt us again before deciding on any action.
