HONG KONG: PROPOSED APPOINTMENTS

You will wish to see the attached letter from Mr Bourne, which I have discussed briefly with Sir Ian Sinclair.

2. We think that Mr Bourne overstates the arguments against the two appointments, though I must admit myself to have argued against making the A.G of a colony C.J. when it was first suggested that Sir Denys (then Mr) Roberts, then A.G. Hong Kong, should succeed Sir Ivo Rigby as C.J. Hong Kong. I believe the C.J. of Bermuda (Astwood) was appointed when Solicitor General of Bermuda.

3. On the assumption that you still favour the proposed appoint- ments, you may wish to consider a submission to the Secretary of State with a draft minute for him to send to the Lord Chancellor. In this we should endeavour to meet Mr Bourne's arguments and I shall of course be ready to help in its preparation. One point would be partly met by letting Yang J resign, but he will want an assurance rather like that given to Mr (now Sir Denys) Roberts.
