As a general rule, the reason or reasons for the reprieve of
condemned prisoners are not disclosed.
Section 65(1) of the Dominica Constitution vests the authority for reprieve in the Governor whose powers in that regard are exercised in accordance with the advice of such Minister as may from time to time be designated by him, acting in accordance with the advice of the
Premier,
The Minister so designated, is the Chairman of the Advisory Committee on the Prerogative of Mercy, the functions of which are set out at Section 67 of the Constitution.
After obtaining the advice of the Committee, he (the Minister) decides in his own deliberate judgement what advice to tender to the
Governor.
