EUROPEAN COMMUNITY LAW

Mrs. Wise asked the Attorney-General whether there have yet been any cases in which United Kingdom judges have been called upon to decide between laws enac- ted by Parliament and EEC legislation; and whether he accepts the statement in the EEC Commission background report, issued 22nd May, that such conflicts can arise.

The Solicitor-General: I am not aware of any case in which a United Kingdom judge has been called on to decide between laws enacted by Parliament and directly applicable Community law. It is possible that, under the constitutions of some member States, such a conflict could arise.

Mr. Christopher Price asked Attorney-General whether the published cost of the report by the Honourable Sir Henry Fisher into the Confait includes the cost of legal representation for the Director of Public Prosecutions; and, if not, what these costs were.

The Attorney-General: Yes.

Security Companies (Departmental Hire)

Mr. George asked the Secretary of State for Foreign and Commonwealth Affairs if he will list those private security companies hired by his Department in the last five years and explain their respousi- bilities; what has been the expenditure on each and the total for each year since 1973; and what criteria his Department take into account in choosing which com- pany to hire.

· Mr. Tomlinson: The Foreign and Commonwealth Office has employed private security firms in this country to control access to some buildings in the past and still does use their services to take cash receipts to the bank. Firms which have been employed are Securicor, Security Express and Burns. As com- mercial confidences are involved, my right hon. Friend would prefer to give the aggregate figures for expenditure. These are as follows:

EUROPEAN COMMUNITY (ACCESSION CONVENTION) }

Mr. William Hamilton asked the Attorney-General when it is proposed to sign the draft accession convention to the EEC convention on jurisdiction and the enforcement of judgments in civil and commercial matters.

The Solicitor-General: There will be an opportunity to sign the draft con- vention when Ministers of Justice next meet, which may be early in October 1978.

DUCHY OF LANCASTER'S STAFF (RETIREMENT)

Mr. Greville Janner asked the Chan- cellor of the Duchy of Lancaster at what average age men and women, respec- tively, employed in his Department have retired in each of the last five years.

Abroad, guards have been obtained through one private firm-KMS Limited -to protect ambassadors at a very few particularly exposed posts. In addition,

some missions have hired watchmen from local security firms but details of these arrangements are not readily available.

The Department looks for reputable firms able to provide a good and con- sistent standard of service.

Dependent Territories

Mr. Lee asked the Secretary of State for Foreign and Commonwealth Affairs if he will stipulate the latest dates by which the remaining British dependent territories will have become independent so as to facilitate the most orderly hand- over and to enable those persons likely to constitute the successive Governments of certain of these territories to make
