I have now been through these papers again and I agree with the comments contained in your second paragraph. I think we must make it quite clear that Mr Champion's letter at Flag A remains the basis on which these disciplinary cases are conducted. As you say as regards CR 59 the Kent case threw up nothing new as regards the Champion letter: the difficulties arose from Hong Kong ignoring the points that the letter made. I think we must say to Hong Kong as regards CR 55 that the Yaumatei case was an exceptional decision and should not be seen as a move away from the considerations of CR 55 in Mr Champion's letter which also remains their stated.
