1. I am grateful for Mr Green's minute of 10 August below. it turned out my discussion with Sir D Luddington about the handling of corruption cases was in general terms, though I did take the opportunity to underline our reluctance to see CR55 used again.

We must now decide what response to make to Mr Hunter's letter of 10 July. It is not enough, as Mr Bickford suggests (his minute of 7 August) to take the line that Mr Champion's 1974 letter "remains the basis on which these disciplinary cases are conducted". Mr Champion's letter no doubt remains generally valid, and it does provide some guidance on the way to handle corruption cases. But events have moved on since 1974, and it is entirely reasonable that Hong Kong should wish to have an agreed procedure for dealing with corruption cases under Colonial Regulations. We should therefore aim to provide detailed comments on the note sent to us by Mr. Hunter. I should be grateful to see a draft cleared by the Legal Advisers.

3. Sir D Luddington told me yesterday that he was exploring the possibility of taking disciplinary action before the institution of criminal proceedings in appropriate cases. He made it clear that consideration of this idea in Hong Kong had not yet got very far and I see no need to comment on it formally unless and until it is put to us.

But it might be worth giving it some thought in the meantime.
